A BILL to amend and reenact section ten, article two, chapter
thirty-three of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to removing
territorial rating of premiums for automobile insurance in
the state so that all rates are uniform statewide.
Be it enacted by the Legislature of West Virginia:
That section ten, article two, chapter thirty-three of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2. INSURANCE COMMISSIONER.
§33-2-10. Rules.
The commissioner is authorized to promulgate and adopt such
rules and regulations relating to insurance as are necessary to
discharge his or her duties and exercise his or her powers and to
effectuate the provisions of this chapter and to protect and safeguard the interests of policyholders and the public of this
state. Notwithstanding any provision of law to the contrary, the
commissioner shall cause rules to be made that insure that West
Virginia is regarded as one single territory for automobile
insurance rating purposes.
NOTE: The purpose of this bill is to establish uniform
insurance premiums rates for automobile insurance throughout the
state.
